- Provide correct station data (location, opening hours, access, prices in €/kWh, connector types)
- Properly maintain the station
- Comply with all applicable laws and regulations
- Provide a valid payment method for receiving payouts
- Keep the charging station publicly accessible and non-discriminatory
5. Special Regulations for Commercial Operators

- Deposit a valid payment method
- Treat charging stations with care

- Pay the agreed amounts after charging sessions
7. Prices and Billing
The prices for charging sessions are set by the operator and displayed in the app. Billing is based on actual energy consumption in €/kWh.
cocharge retains a service fee of 15% of charging revenues. The operator receives 85% of revenues.
cocharge pays out the payments collected on behalf of the operator from charging sessions at the operator's charging stations within 6 weeks after the end of the calendar month in which the respective charging session took place.
8. One-Time Connection Fee
8.1. For setting up the customer's charging station (wallbox) in our backend system, we charge a one-time connection fee of €75.00 gross, including statutory VAT.
8.2. The connection fee covers the following services:
8.2.1. creating and registering the charging station as a station in our system, including the associated administrative and setup costs;
8.2.2. one online configuration appointment via video conference (Google Meet), in which we support the customer in connecting the charging station to our backend system.
8.3. The configuration appointment can only take place if, at the agreed time, the charging station is fully installed or assembled, connected to the internet and technically operational. If these conditions are not met, our service under section 8.2.2. is deemed to have been offered; there is no entitlement to a further free appointment.
8.4. Services beyond the scope set out in section 8.2. are not included in the connection fee. If the customer requires further support, we can provide it by prior agreement for a separate fee based on effort according to our price list in effect at the time. For on-site work (e.g. installation, troubleshooting the hardware or the network), the customer must commission a qualified electrical contractor or technician at their own expense.
9. Reservations
Users can reserve charging stations up to 48 hours in advance.
- Cancellations up to 3 hours before the scheduled time are free of charge
- Later cancellations may incur fees
10. Liability
cocharge is not liable for:
- Damage caused by improper use of charging stations
- Interruptions in availability
- Actions or omissions of operators or users
The liability of cocharge is limited to intent and gross negligence, insofar as legally permissible.
11. Contract Duration and Termination
The contract is concluded for an indefinite period.
- Users can terminate at any time
- Operators can terminate with 30 days notice
- cocharge can terminate with 30 days notice
The right to extraordinary termination for good cause remains unaffected.
12. Data Protection
The collection and processing of personal data is carried out in accordance with our Privacy Policy.
13. Changes to the GTC
cocharge reserves the right to change these GTC. Changes will be communicated with at least 15 days notice (for commercial operators) before they take effect. In case of non-acceptance, users and operators can terminate the contract.
14. cocharge Wallet (Credits)
14.1 Nature of wallet credits
- Wallet credits are promotional value granted by cocharge through eligible programs (e.g. referral programs) or as a credit granted by cocharge (e.g. as goodwill or to correct an error). Customers do not pay money to acquire credits; the wallet cannot be topped up against payment.
- Credits have no cash value, bear no interest, cannot be paid out or exchanged for cash, and cannot be transferred between accounts.
- Credits are denominated in EUR and can only be applied to paid cocharge charging sessions at network stations that are billed through the customer's account to the registered payment method. Free sessions (e.g. at the customer's own stations) do not consume credits.
- Using credits does not reduce the payout to the operator of the station used; the operator is paid as if the session had been paid entirely with a payment method (Section 7 applies unchanged). cocharge bears the credit portion.
14.2 Expiration
- Each issued credit batch has an expiration date set at issuance. The default lifetime is 12 months from the issuance date.
- Individual programs may set a shorter or longer lifetime; the applicable period is shown to the customer at the time of issuance. The expiration date of each credit batch can also be viewed in the wallet at any time.
- Spending part of a credit batch does not extend the expiration of the remainder.
- For credits that have not been spent, cocharge sends expiration reminders 30 days and 7 days before expiry, and a notice on expiry, as a courtesy. Non-receipt of a reminder does not extend the expiration date or create a right to re-credit.
- Unspent credits are forfeited without compensation on expiry. Expired credits are removed from the spendable balance automatically and are not restored.
14.3 Order of consumption
- When multiple credit batches exist, the batch closest to expiration is consumed first.
- When the wallet toggle is on, credits are applied to the session total after the session ends and before any charge is made to the registered payment method. The payment method is charged only for the remainder.
- If no payment method is registered, or the invoice for the remainder cannot be created, the credits applied to that session are returned to the wallet. Credits that have expired or been revoked by cocharge in the meantime are not restored.
- If the charge to the payment method for the remainder is declined, the credits remain applied to that session's invoice; the outstanding remainder continues to be collected from the registered payment method.
14.4 Wallet toggle
- New wallets have the "Use wallet credits for charging sessions" setting enabled by default.
- Customers may turn the setting on or off at any time in account settings.
- A change to the setting applies only to charging sessions started after the change. Sessions already in progress continue under the setting in effect when the session began.
14.5 Refunds
- When a charging session paid wholly or partially with wallet credits is refunded, the credit portion is credited back to the wallet as a new credit (not paid out as cash and not refunded to a payment method). This is currently done by cocharge through the support process, and the new credit carries its own expiration date.
- The payment-method portion of a refunded session is refunded through the original payment method using the standard refund process.
- Partial refunds are applied proportionally across the credit portion and the payment-method portion of the original session.
- If the credit batch from which the original credit portion was drawn has already expired at the time of refund, the credit portion is not restored to the wallet.
14.6 Account closure
- On account closure, any remaining credit balance is forfeited.
- Forfeited amounts are recorded in cocharge's internal records for audit purposes.
14.7 cocharge actions on credits
- cocharge may revoke credits in cases of fraud, abuse, or breach of program rules, with notice to the customer where reasonably possible.
- cocharge may correct credits issued in error.
- A revocation or correction only affects credits not yet spent; it never takes the balance below zero.
- All such actions are recorded together with the reason and the time of action.
14.8 Receipts and metering
- The wallet split shown to the customer is informational. It does not replace or alter the calibrated charging-session receipt (kWh delivered, price per kWh, total) that the customer receives in accordance with German calibration law (Eichrecht).
14.9 Tax treatment
- All amounts displayed in the wallet and on session receipts are gross amounts and include applicable VAT.
14.10 Programme changes
- cocharge may modify or discontinue credit-issuing programs at any time with reasonable notice.
- The terms applicable to a credit batch at the time it was issued continue to apply to that batch; programme changes are not applied retroactively to the customer's detriment.
14.11 Data retention
- Wallet transaction records are retained for the period required by German commercial and tax law (currently 10 years under §257 HGB / §147 AO). This retention obligation applies independently of any data-deletion request and is reflected in cocharge's Privacy Policy.
14.12 Support and disputes
- The transaction history can be viewed in the wallet (web and app) at any time. Customers may also request a full export of their wallet transaction history via the standard support channel.
- Disputes about wallet balance, issuance, or spend are handled through the existing cocharge support process.
15. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes is Bremen, insofar as legally permissible.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
